By downloading an instrumental produced by SINIMA BEATS, you agree to the following Terms and Conditions of the Free Download Policy:  

1. LIMITED USE.  The downloaded instrumental(s) is available for non-profit use only. It cannot be used for any commercial or profitable means under any circumstance, as it would violate the Free Download Policy.  Any financially-exploitative use will immediately cease your rights to the Free Download Policy.  A license must be purchased or appropriately obtained through SINIMA BEATS to avoid litigation.
   1. Acceptable use includes:
      1. Permission to post your recorded song via the Internet through such social sites as Myspace, Youtube, Facebook, Soundclick, and/or any other Internet websites with appropriate credits given to SINIMA BEATS (see II. CREDITS).
      2. Permission to reproduce no more than 60 physical copies of a recording on the instrumental.
      3. Permission to redistribute the instrumental in its original form with all original file names and credits intact (see II. CREDITS) through any non-profit mediums.
      4. Permission to perform live on the instrumental in an entirely non-profit show, for an entirely non-profit cause.           
   2. Unacceptable use includes, but not limited to:
      1. The use of the instrumental through any means that would lead to commercially broadcasting exposure such as television or radio.
      2. The alteration of the instrumental in any way, shape, or form without purchasing a license.

2. CREDITS.  You are required, per this policy, to give appropriate credits to SINIMA BEATS by including “Produced by SINIMA BEATS” or “Beat from SINIMABEATS.COM” in text on all official documents and surfaces of physical copies of your song recorded on the instrumental.  In the case that text credits cannot be made present, vocal credits are required in the method of verbally announcing production credits (“SINIMA on the beat”, “SINIMA BEATS”, or “SINIMABEATS.COM,” etc) either in the intro or outro of the recorded song.

3. LIABILITY.  SINIMA BEATS (associates and/or employees) are not held responsible, under any circumstance, for any and all liability, losses, costs, and/or expenses (including attorneys’ fees) incurred in connection with any claim arising from your use of the instrumental, including but not limited to claims for defamation, violation of rights of publicity and/or privacy, copyright infringement, trademark infringement, and/or any claim or liability relating to the content, quality, or performance of materials in relation to the instrumental.  You are advised to use any and all instrumentals (obtained through the free download) at your own risk.  

4. LITIGATION.  SINIMA BEATS reserves the right to take legal actions at our sole discretion if we feel that you (and your associates) may have violated our Free Download Policy to the fullest extent of the law.  Any unauthorized use, unauthorized reselling, and/or copyright infringement (e.g failure to give appropriate credits to SINIMA BEATS) of any and all instrumentals will result in litigation if we see fit.  We have the discretion to pursue financial compensation as a result of any violation to the policy.

5. SUBJECT TO CHANGE.  SINIMA BEATS reserves the right to terminate this agreement and/or your rights of use and/or distribution at our sole discretion at any given time.  Likewise, The Free Download Policy is subject to change at our sole discretion at any time without notice.
